Decriminalization of Homosexuality: Road Ahead for the LGBTQ community of India

 India has always been a lot repressed when it comes to matters of homosexuality. Not until some years back, discussions on homosexuality were still a taboo. And those that had the courage to openly embrace their homosexuality were looked down upon. Even the constitution of India criminalized homosexual relationships in its article 377.

   

Just two years back, in September 2018, the Supreme Court of India passed a legendary judgment when it announced the scraping of the Constitution Article 377. There were celebrations all over the country, pride parades were evident celebrating their freedom to love people, to be in a relationship. But, the really question is- has this changed things? The answer, quite evidently is no. There are still many homosexuals out there, fighting for their identities. They still have to struggle to find jobs even if they have all the required qualifications because some narrow minded people still to judge their sexuality as a flaw. Also, scraping away of the article 377 still does not allow homosexuals to marry the people that they love so dearly. That is still a crime in the eyes of the Indian jurisdiction. Clearly, they are at a loss of the basic human rights that everyone should be allowed to exercise. 


This indicates that homosexuals are still a long way apart for exercising equal rights as compared to the heterosexual people in India. Equal rights for them, is still a distant dream. The decriminalization of homosexuality is just a small beginning towards the bigger fight for their basic rights to live.

  1. Absolutely agree with you. I would like to add that although it will take much longer before we see any significant change in the attitude of our society towards homosexuality but there is hope as the newer generations are being made aware, mostly through the internet, and the general mentality is slowly shifting more towards acceptance. It will be a drawn out battle for the LGBTQ community but I think it is safe to assume that they will surely reach that goal.

  3. Everyone has the birthright be emotionally attached to whoever they want. The LGBTQ community has faced a lot of oppression around the world. It's high time we realise that not only making laws, but also changing mindset of people is also important.
